JURY AWARDS $3.5 MILLION TO TREE CLIMBER
A Mobile County jury awarded an injured tree-service worker $3.5 million following a four day trial. Michael Nall, age thirty-one, was injured on May 2, 2000 when the telescopic boom of the bucket truck he was working in collapsed. Mr. Nall and the bucket fell thirty feet. At the time, Mr. Nall was trimming tree limbs back from power lines. The bucket truck, only weeks old, was manufactured by Altec Industries, Inc. of Birmingham, Alabama. One of Mr. Nall’s attorneys with the Mobile law firm of Taylor, Martino, Kuykendall, stated that “Altec failed to install eight bolts on the telescopic arm, and the link separated unexpectedly and without warning” Following the fall, Mr. Nall was taken to USA Hospital where he remained in ICU for five days. He suffered broken ribs, a lacerated spleen, a disruption of his sacro-iliac joint, and a host of other injuries. At trial, Altec contended that Mr. Nall did not have permanent injuries as a result of the fall. “This is one of the issues that the jury had to resolve. We are very happy they resolved it in Mr. Nall’s favor.
Mr. Nall was working for Burford Tree Surgeons at the time of the fall. He is married to Dianne Nall, and they have two children. Mr. Nall was only twenty-five at the time of the accident and has been unable to return to his job as a tree surgeon.
“The verdict is for compensatory damages only”, said Richard H. Taylor, another attorney representing Mr. Nall. “This was not a big punitive damages verdict people often complain about. Mr. Nall’s ability to work and provide for his family was greatly affected by Altec’s failure to install the safety bolts, and this award will help him regain some quality of life”, Taylor said. Taylor also said that Altec’s in-house lawyer tried to settle with Mr. Nall right after the accident when Mr. Nall was still recovering from his injuries. “However, Mr. Nall decided to let a Mobile County jury decide his case for him”, Taylor said. “This case is an example of how effective and reliable our jury system can be when a case has merit”, Taylor added.
